Acceptance Of Terms
These Terms of Service govern your access to and use of the BridgeWatch website, mobile application, accounts, alerts, bridge-status information, camera views, predictions, donation or subscription flows, APIs, content, and related services. By accessing or using BridgeWatch, you agree to be bound by these Terms and by any additional policies or notices that are expressly incorporated by reference.
If you do not agree to these Terms, do not use BridgeWatch. If you use BridgeWatch on behalf of a company, organization, or other entity, you represent and warrant that you have authority to bind that entity to these Terms, and “you” includes that entity.
Eligibility, Accounts, And Security
You must provide accurate, current, and complete information when creating or maintaining an account and must keep your credentials confidential. You are responsible for activities occurring under your account to the extent caused by your acts, omissions, or failure to safeguard credentials or device access.
You must promptly notify BridgeWatch if you suspect unauthorized access to your account, push-notification registration, or device settings. BridgeWatch may suspend, restrict, or terminate accounts or credentials where reasonably necessary to protect the service, users, or third parties.
License And Permitted Use
Subject to your compliance with these Terms, BridgeWatch grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the service for your personal, internal, or other lawful authorized purposes.
You may not use BridgeWatch in any manner that violates applicable law, infringes another party’s rights, misuses service content, bypasses access controls, interferes with the operation of the service, or attempts to obtain unauthorized access to systems, accounts, tokens, data, or infrastructure.
Prohibited Conduct
Without limiting the generality of these Terms, you may not: copy, reproduce, republish, distribute, publicly display, or create derivative works from BridgeWatch content except as permitted by law or express permission; reverse engineer or decompile restricted portions of the service except where non-waivable law allows it; circumvent rate limits or access restrictions; probe or scan systems for vulnerabilities; use bots, scraping tools, or automated means in a manner that burdens or extracts protected service content without permission; or use the service to facilitate unlawful, deceptive, or harmful conduct.
You may not use BridgeWatch as an emergency, dispatch, maritime-navigation, traffic-control, or public-safety system, and you may not represent BridgeWatch output as an official government, operator, or safety authority communication.
Important Safety, Availability, And Accuracy Disclosures
BridgeWatch provides informational tools only. Bridge status indicators, opening predictions, live feeds, camera imagery, historical summaries, alerts, and related content may be delayed, unavailable, incomplete, corrupted, or inaccurate.
You must not rely on BridgeWatch as your sole source of navigation, transportation, maritime, emergency, or safety information. Always obey posted signs, bridge operators, vessel traffic, weather conditions, road conditions, local laws, and instructions from public authorities and use your own judgment when making travel or safety decisions.
BridgeWatch does not guarantee that any alert will be delivered, delivered on time, or delivered to the correct device, and service interruptions may occur because of internet outages, device settings, app permissions, operating-system behavior, third-party provider failures, upstream data issues, maintenance, or force majeure events.
Third-Party Services And External Content
BridgeWatch may rely on third-party services, including app stores, payment processors, notification providers, camera-feed operators, map providers, hosting providers, and public-data sources. BridgeWatch is not responsible for third-party services, infrastructure, policies, outages, content availability, pricing changes, data accuracy, or acts or omissions of those third parties.
Links to third-party websites or services are provided for convenience and do not necessarily constitute endorsement. Your use of third-party websites, applications, or checkout flows may be governed by separate terms, billing rules, privacy notices, and refund policies.
Donations, Subscriptions, And Billing
BridgeWatch may offer optional donations, subscriptions, premium features, or checkout flows through third-party providers or app stores. Pricing, taxes, billing timing, renewals, cancellations, free trials, refunds, chargebacks, and payment disputes may be determined in whole or in part by the applicable third-party provider or app-store rules.
Unless BridgeWatch expressly states otherwise in writing, optional donations or paid features do not create a guaranteed service level, uptime commitment, individualized support obligation, fiduciary duty, or warranty of any kind.
User Content, Feedback, And Communications
If you submit feedback, suggestions, reviews, support messages, bug reports, or other communications to BridgeWatch, you grant BridgeWatch a non-exclusive, worldwide, royalty-free right to use, reproduce, modify, adapt, and incorporate that feedback for the purpose of operating, improving, and promoting the service, without obligation to compensate you, except where prohibited by law.
You represent that information you submit to BridgeWatch will not knowingly violate law or another party’s rights. BridgeWatch may remove or decline to act on communications that it reasonably believes are unlawful, abusive, misleading, or operationally harmful.
Intellectual Property Rights
BridgeWatch and its trademarks, service marks, logos, software, text, design, visual interface, data compilations, and related service content are protected by intellectual-property and other laws. Except for the limited license expressly granted in these Terms, BridgeWatch and its licensors reserve all rights, title, and interest in and to the service and related content.
Nothing in these Terms transfers ownership of BridgeWatch intellectual property to you. You may not remove proprietary notices or use BridgeWatch branding in a way that implies endorsement, affiliation, or sponsorship without BridgeWatch’s prior written consent.
Termination, Suspension, And Service Changes
BridgeWatch may modify, suspend, restrict, or discontinue all or part of the service at any time, with or without notice, for maintenance, upgrades, security, legal compliance, abuse prevention, business reasons, or circumstances outside BridgeWatch’s control.
You may stop using the service at any time. BridgeWatch may suspend or terminate your access if BridgeWatch reasonably believes you violated these Terms, created risk to the service or others, or if continued access is impracticable, unlawful, or inconsistent with BridgeWatch’s operational needs.
Disclaimers Of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIDGEWATCH IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, QUIET ENJOYMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
WITHOUT LIMITING THE FOREGOING, BRIDGEWATCH DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT IT WILL ALWAYS BE AVAILABLE, THAT ERRORS WILL BE CORRECTED, THAT NOTIFICATIONS WILL ARRIVE, OR THAT BRIDGE STATUS, PREDICTIONS, OR CAMERA FEEDS WILL BE ACCURATE OR TIMELY.
Limitation Of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIDGEWATCH, ITS OPERATORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND RELATED PERSONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, GOODWILL, TRAVEL OPPORTUNITY, PERSONAL TIME, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF BRIDGEWATCH AND ITS OPERATORS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID DIRECTLY TO BRIDGEWATCH FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the foregoing provisions may not apply to you to the extent prohibited by law. In those jurisdictions, the provisions will apply to the maximum extent permitted.
Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless BridgeWatch and its operators, affiliates, licensors, and service providers from and against claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your misuse of the service, your violation of these Terms, your violation of applicable law, or your infringement or misappropriation of any rights of another party.
Governing Law And Venue
These Terms and any dispute arising out of or relating to them or the service are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, exclusive venue for disputes relating to these Terms or the service will lie in the state or federal courts located in Charleston County, South Carolina, and the parties consent to personal jurisdiction and venue in those courts.
Miscellaneous
These Terms constitute the entire agreement between you and BridgeWatch regarding the subject matter covered here and supersede prior or contemporaneous understandings relating to that subject matter, except to the extent additional terms expressly apply to a specific feature or offering.
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary and the remaining provisions will remain in full force and effect. BridgeWatch’s failure to enforce any provision is not a waiver of future enforcement. You may not assign these Terms without BridgeWatch’s prior written consent, and BridgeWatch may assign these Terms in connection with a business transfer or by operation of law.
Changes To These Terms And Contact
BridgeWatch may revise these Terms from time to time. Updated Terms become effective when posted unless a later effective date is stated. Your continued use of the service after the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by law.
